RankVision Terms and Conditions

These Terms and Conditions are the agreement (?Agreement?) between You (the private or commercial person who fills out the subscription form) and the company operating RankVision (?RankVision?). Any affiliated persons to You who you subscribe to RankVision, such as your developers (?Developer?), are also bound by the terms of this Agreement.

1. RankVisionMembership. RankVisionmembership can be obtained by filling out the registration form, andaccepting the present Agreement and the Privacy Policy. RankVisionreserves the right to refuse any application at any time at its solediscretion, or to terminate your account at any time without anynotice in its sole discretion.
2. Websites. As a RankVision member, you will have access to a dedicated, passwordprotected control panel (?Control Panel?). In this Control Panel youcan add any number of websites to your account. Once you add awebsite, RankVision will start immediately to crawl the website, andcollect the information needed by the different modules (?Modules?).RankVision may refuse the right for a website to be added at any timeat its sole discretion, and RankVision has the right to remove anywebsite which is added already to the system at any time, withoutnotice, at its sole discretion.
3. Modules. Thewebmaster tools offered by RankVision are generically called Modules.Each Module performs a different task. Some of these modules areperforming their tasks based on the collected information from yourwebsites during the crawl (?Crawl?) process, some of them aregenerating results on demand, and some of them are using third partysoftware to be able to display the information for you. RankVisionreserves the right to add, remove, or change any Module, at any timewithout notice at its sole discretion. RankVision may refuse at itssole discretion the use of a particular module for any website,without further explanation.
4. Developers. Asa RankVision member, You are entitled to add Developers to yourMembership. You are allowed to add any number of Developers toyour websites, and it is also at your sole discretion what rights Youdecide to give your Developer(s) (which of your websites are going tobe visible for the Developer, and which of the modules are accessiblefor the Developer). RankVision does NOT intermediate disputes betweenYou and any of the developers you have in our system. It is solely atyour discretion to add Developers to your account, or remove them.Once you remove a Developer, his login rights are immediatelydeactivated and he can no longer access the RankVision Control Panel.
5. TheCrawl. Thecrawling process is used by RankVision to collect information fromyour website(s). You hereby agree that RankVision will crawl yourwebsite(s) based on an automated schedule. Depending on the size ofyour website(s), the crawler runs in different time intervals, so wedon?t put unnecessary pressure on your and/or RankVision servers. Thecrawler runs: a) every 24 hours for websites which has up to 49pages; b) every 48 hours for websites which has between 50 and 149pages; c) every 72 hours for websites which has between 150 and 249pages; d) every 5 (five) days for websites which has more than 250pages. RankVision reserves the right to change the crawler schedulesand conditions at any time in its sole discretion without notice.
6. FairUse. Youare solely responsible for the fair use of RankVision. By submittingthe registration form you agree to: a) subscribe only your ownwebsites to the RankVision webmaster tools; b) the information whichyou will have access to due to RankVision You will not use forillegal or immoral purposes, only to enhance your websitefunctionality, search engine rankings and visitors experience.
7. NoGuarantee. RankVisiondoes not guarantee you that the use of our Modules and/or followingany advice from RankVision will increase your ranking in searchengines, increase your traffic, increase your conversion, or anythingelse not specified hereby. The purpose of RankVision is to provideyou with information that will enable you to make your site better,but this does not mean that we guarantee any success or improvement.
8. NoWarranty. RANKVISIONGIVES NO WARRANTY, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATIONTHE INFORMATION COLLECTED AND DISPLAYED BY ANY OF OUR MODULES, THEUSE OF THOSE INFORMATIONS, THE CORRECT FUNCTIONALITY OF ANY MODULE ORSERVICE RELATED TO RANKVISION.

10. TrialPeriod. When You add your first website to RankVision, You are eligible for a 30 days trial period (?Trial Period?) so You can decide wether You wantto use our services or not. The Trial Period refers only to the firstwebsite you add to the system, or by the time your first Trial Periodexpires. This means that if You add a website before the Trial Periodfor your first website expires, You will not be charged. However, themoment when your first Trial Period expires you will be charged forall the websites you may have entered in the meantime.
11. Payment. Paymentsare always done upfront for the following 30 (thirty) days. When Youadd a website to RankVision, You will have to enter your paymentdetails, and automatically a recurrent payment is initiated inPaypal. RankVision will start to charge You after the expiration ofthe Trial Period as defined above. The payment for every website is aset amount per month as advised from time to time by RankVision,however additional services might be charged separately as theyappear. Failing to process your payment for the following 30 days will result in immediate suspension of those website(s) which for thepayment didn?t went trough. You will have 30 (thirty) days from that moment to process the payment, otherwise all the information aboutthe website(s) which for the payment didn?t go through will bedeleted. RankVision reserve the right to change entirely or partiallyits payment policy without notice at its sole discretion.
12. Termination. RankVisionwill continue charging You for every website You have added to yourControl Panel. You can stop the payments by deleting any or all ofthe websites from your Control Panel. If You decide to delete awebsite, that operation is immediate, and the recurring payment forthat website will be stopped immediately. However, RankVision willnot return any part of the already paid amounts, regardless of theday you decided to stop the payments. In case You decide to cancelthe subscription for any website, You have the possibility toreinstate the deleted website and all the information within 15(fifteen) days. In this case, You will have to pay a set reconnectionfee, and the recurring billing is automatically restarted from themoment you reinstate the website. After the 30 days period expires,all the information will be permanently lost.
13. Miscellaneous. ThisAgreement shall be governed by the laws of the United Kingdom. Anydispute or claim regarding this Agreement shall be adjudicated inGuernsey, Channel Islands, where the headquarters of the companyoperating RankVision resides. RankVision reserves the right to modifythis agreement. In this case, You will be notified in email or viayour control panel about the changes to this Agreement and in theevent that You continue to use our services, RankVision considersthat You expressly agree with the changes.
